Terms & Conditions

These Terms and Conditions govern the use of the online store operated by HIGHTIDES KG, located at Weinstrasse 35, 39040 Tramin (BZ), Italy (VAT ID: P.Iva 03193440215). By accessing and using our website, you agree to comply with and be bound by the following Terms & Conditions, in accordance with Italian law (Legislative Decree No. 206/2005 – Consumer Code and Legislative Decree No. 70/2003 on e-commerce). 

 

1. General Information

1.1 These Terms and Conditions apply to all sales made through our website.
1.2 The website is operated by HIGHTIDES KG, and all purchases made through this website are legally binding agreements between the buyer and the seller.
1.3 By placing an order, you confirm that you are at least 18 years old or have parental/guardian consent.
1.4 We reserve the right to modify these Terms and Conditions at any time. Changes will take effect from the date of publication on the website.

2. Products & Orders

2.1 Our store specializes in custom-made fine art photo prints. Each piece is individually printed and framed according to the customer’s selection.
2.2 Due to the custom nature of our products, slight variations in color, texture, and framing may occur.
2.3 The images displayed on our website are as accurate as possible, but they may differ slightly from the final product due to screen calibration differences.
2.4 Orders are confirmed via email upon successful payment processing.
2.5 We reserve the right to refuse or cancel an order for any reason, including pricing errors, stock availability, or suspected fraudulent activity.

3. Pricing & Payment

3.1 All prices on our website are listed in EUR (€) and include VAT, where applicable, in accordance with Italian and EU regulations.
3.2 The total price, including taxes and shipping costs, will be displayed at checkout before completing the purchase.
3.3 We accept the following payment methods:

  • Credit and Debit Cards
  • PayPal
  • Bank Transfer (upon request)
    3.4 Payment must be made in full before production begins.
    3.5 In case of any pricing errors, we reserve the right to correct the price and contact the customer before proceeding with the order.

 

4. Shipping & Delivery

4.1 Each product is made-to-order and requires 2 weeks for production before being shipped.
4.2 Once dispatched, customers will receive a tracking number via email to monitor their shipment.
4.3 Shipping times vary based on the destination. Standard estimated delivery times:

  • Italy: 3-5 business days
  • EU Countries: 5-10 business days
  • Non-EU Countries: 10-20 business days (subject to customs clearance)
    4.4 Customs & Import Duties: International orders may be subject to customs fees, duties, and taxes, which are the responsibility of the customer.
    4.5 Delivery Delays: We are not responsible for delays caused by shipping carriers, customs, or force majeure events (e.g., natural disasters, strikes, pandemics).


5. Returns, Cancellations & Refunds

5.1 Due to the custom nature of our products, we do not accept returns or exchanges, except in cases of damage or defects.
5.2 Order Cancellations:

  • Cancellations are only accepted within 24 hours after placing the order. After this period, production begins, and the order cannot be modified or canceled
  • If your item arrives damaged, please contact us within 7 days of delivery with photos of the damage and packaging.
  • We will review the claim and either offer a replacement or refund, depending on the extent of the damage.
  • Customers are responsible for returning the defective item if required for assessment

 

6. Intellectual Property & Copyright

6.1 All images, artwork, designs, and content on this website are the exclusive property of MIDDLEofNOWHERE and are protected under Italian and international copyright laws.
6.2 Any unauthorized reproduction, distribution, or commercial use of our artwork and website content is strictly prohibited.
6.3 Customers may not reproduce, modify, or resell any of the prints purchased from our store.

7. Privacy & Data Protection

7.1 We process customer data in compliance with the EU General Data Protection Regulation (GDPR) and Italian data protection laws.
7.2 Personal data is collected solely for the purpose of processing orders and will not be shared with third parties except as necessary for fulfillment (e.g., shipping services).

8. Governing Law & Jurisdiction

8.1 These Terms and Conditions are governed by Italian law.
8.2 Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Bolzano, Italy.
8.3 Customers located within the European Union also have the right to resolve disputes through the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
